Homestay Terms and Conditions

1.        Voluntary Participation. I have voluntarily chosen to apply to participate in the Program and have completed this Host Application Form in the spirit of goodwill and friendship. I hereby represent and warrant that all persons in my household (myself included) are of good character and there is nothing to my knowledge that would preclude our acting as Host to Guest(s) during the Games as part of the Program.

2.       Acceptance of Guest(s). If my application is accepted by VANOC and I am accepted as a Host in the Program, I agree to accept any Guest(s) assigned to me, regardless of their race, religion, lifestyle or national origin, and I agree to respect their cultural traditions and beliefs and welcome them into my home as special guest(s). I understand that the reason that my Guest(s) are coming to British Columbia is to volunteer at the Games, and that they will spend most of their time at the Games. I will make every effort to make my Guest(s) feel at home, however; and will look for ways to include them in the daily activities of my household. I will endeavor to provide them with a comfortable and safe home.

3.       VANOC’s Right of Termination. I acknowledge and agree that VANOC may terminate my or my family’s participation in the Program and/or my status as a Host at any time if I fail to comply with the provisions of this Agreement or engage in serious misconduct which in VANOC’s opinion adversely affects the integrity and/or interests of the Program, VANOC, the International Olympic Committee (the “IOC”), the International Paralympic Committee (the “IPC”), the Canadian Olympic Committee (the “COC”), the Canadian Paralympic Committee (the “CPC”) or any other organization participating in the Program.

4.       No Liability for Unrelated Parties. I acknowledge and understand that none of the Dominion of Canada, the Province of British Columbia, the Resort Municipality of Whistler, the District of Squamish, the Municipality of West Vancouver, the City of North Vancouver, the District of North Vancouver, the City of Vancouver, the City of Richmond, the IOC, the IPC, the COC, the CPC nor any department, agency, director, officer, trustee, member, minister, councilperson, servant, employee, agent, volunteer or representative of any of the foregoing entities  (each, an “Unrelated Party”) shall incur any financial responsibility or liability of any kind or nature whatsoever by virtue of or arising from: (a) the Unrelated Party’s relationship with VANOC, and/or (b) the Program.

5.       Indemnity.  I agree to indemnify and save harmless VANOC and its past and present directors, officers, members, employees, volunteers, affiliates, agents and representatives (each an “Indemnified Party”) from any losses, claims, damages, actions, causes of action, costs and expenses that an Indemnified Party may sustain, incur or suffer at any time, either during or after the time I act as a Host, which are based upon, arise out of or occur, directly or indirectly, by reason of any act or omission by me in connection with my participating in the Program (whether or not my application is successful) or otherwise arising out of this Agreement. I further understand, acknowledge and agree that VANOC is in no way responsible or liable for the acts, omissions or negligence of any Guest or any other individual (including any Host) associated with the Program.

6.       Assumption of Risk, Waiver and Release.  I acknowledge that having Guest(s) visit and stay in my home may involve certain risks and dangers, including those caused by Guests.  I expressly and specifically assume all such risks.  Furthermore, to the fullest extent permitted by law, I hereby release, waive, covenant not to sue, and discharges VANOC and its past and present directors, officers, members, employees, volunteers, affiliates, agents and representatives, the IOC, the IPC, the COC and the CPC from any and all liability, claims, demands and causes of action whatsoever arising out of or related to any loss, damage, illness, or injury, including death, that may be sustained by me or loss or damage to any property belonging to me arising out of or related to my participating in the Program (whether or not my application is successful).

7.       Security.  I acknowledge that given the sensitivity of security requirements for the Games, VANOC has developed a security protocol that may require me to submit information (including additional personal information) which may be used to conduct a comprehensive security screening as a condition to being a Host.  I hereby acknowledge and agree that VANOC, in conjunction with the Royal Canadian Mounted Police and in cooperation with any applicable local, national and/or international police forces or security agencies, may at any time and from time to time, whether prior to, during or after my time acting as a Host and before March 31, 2010, conduct a criminal records search, police history information search and/or such other security checks and searches as VANOC may require (collectively, “Searches”) pertaining to me and any other person in my household.  I agree that upon VANOC's request at any time and from time to time, I will execute, and cause any other person in my household to execute, VANOC’s Security Clearance Form and/or such other documents or consents as VANOC may require in order to permit VANOC to have the Searches conducted. I further agree that VANOC reserves the right to deny any application to any person or to terminate any person’s status as a Host in the event that VANOC determines, in its sole discretion, that the outcome of the Searches is not satisfactory.

8.       No Publicity and Marketing Rights. I acknowledge and agree that I will not publicly disclose my relationship with VANOC for promotional purposes, including by means of distribution of literature, verbal declarations or announcements through any medium whatsoever (including any sales, marketing or other literature, letters, press releases, brochures, website content or other written materials), without the express prior written consent of VANOC, which consent may be arbitrarily withheld.  I undertake not to use “VANOC”, “Vancouver 2010”, any official emblem, logo or mascot of the Games or any other VANOC identification or trademark, as a reference or means of promotion or publicity, without the express prior written consent of VANOC, which consent may be arbitrarily withheld.  I undertake not to disclose or promote my relationship with VANOC in any communication or manner whatsoever as a basis to create an association, express or implied, between myself and the IOC, the Olympic Games, the Olympic Movement, the IPC, the Paralympic Games or the Paralympic Movement.

9.       Choice of Law. This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein and the parties agree and consent to the exclusive jurisdiction of the courts of British Columbia.
